NextHome Event Terms & Conditions
Thank you for registering for this corporate event (the “Event”), organized by NextHome, Inc., and its affiliates and subsidiaries (“NextHome”). Regardless of whether your registration is submitted by you or your proxy, the following NextHome Event Terms & Conditions (these “Terms”) apply to you and your participation at the Event. Depending on the type of event (in-person or virtual), certain terms herein may not apply. For purposes of these Terms, “Attendee(s)” means all registered ticketholders at the Event, and “Vendor(s)” means all speakers, sponsors, exhibitors, and vendors at the Event. By registering for or attending this Event, you agree to be bound by these Terms, so please read them carefully. If you do not wish to accept these Terms, then you should not register for or attend this Event. Submission of your registration information is regarded as affirmation of your acceptance of these Terms. These terms include and incorporate by reference the NextHome Privacy Policy (found at https://www.nexthome.com/privacy-policy/); if any conflicts exist between these Terms and the NextHome Privacy Policy, these Terms will prevail. NextHome reserves the right, in its sole and absolute discretion, to limit or deny Event access to any entity or individual at any time and for any reason, without refund.
As an Event Attendee, you acknowledge and agree to the following:
EVENT REGISTRATION
- Ticket Confirmation. Upon ticket purchase, you should receive an email confirmation. If you do not receive an email confirmation, your ticket purchase was not completed. Please check your inbox and spam folders as only confirmed Attendees will be admitted at the Event.
- Ticket Cancellations, Refunds, and Transfers. For all paid events, no ticket cancellations or refunds will be provided by NextHome for any reason whatsoever. However, you may transfer your ticket to another NextHome member by notifying us in writing at memberservices@nexthome.com. All ticket transfer requests will be processed within three (3) business days, and will be subject to a transfer fee in the amount of, (a) $50 USD, if submitted at least 14 days prior to the Event; or (b) $100 USD, if submitted within 14 days of the Event (collectively, “Transfer Fee”). Payment to the transferor of the original ticket price, minus the applicable Transfer Fee, will automatically be refunded to the original credit card only after NextHome has received payment from the transferee. If your ticket transfer is not confirmed by our Member Services team 14 days prior to the Event, please call us at 855-925-6398 to confirm your ticket transfer. Any free ($0.00) event is excluded from this paragraph.
- Use of Personal Registration Information. By registering for the Event, you grant NextHome the right to use your personal registration information (including your name, phone number, and e-mail address), which NextHome may, in its sole discretion, use to provide you direct communications from NextHome about the Event, including communications about Vendors or other Event details. By registering for the Event, you authorize NextHome (either directly, or indirectly through an API connection with a third-party registration platform) to share your name, registration status, and personal registration information with Vendors, for marketing, advertising, or informational purposes. Furthermore, to facilitate networking and regional engagement, NextHome may display a public participant list including your name and location (city and/or state) on the Event website and mobile application. NextHome may also use your personal registration information in an anonymous and aggregate format to power a regional “heat map” to showcase attendance volume by area. By registering for the Event, you expressly authorize the public visibility of your name and location (city and/or state) on the participant list, unless you affirmatively opt-out during the registration process or through other means as may be made available by NextHome; provided, however, that your personal registration information may still be used as anonymous and aggregated data for regional heat map volume totals, even if you choose to opt-out of the public participant list. For clarity, age and gender identity information, if collected, is only used internally by NextHome personnel with a need to access such information to perform their business duties and will not be shared with any Vendor. NextHome deploys technical, organizational, and systematic controls designed to prevent unauthorized access, destruction, alteration, or misuse of your personal registration information. Personal registration information entered into third-party systems may be subject to the privacy policy of the third-party system.
- Text Messaging. By registering for the Event, you are consenting to enrollment in NextHome’s recurring text messaging program which may use an automated system to deliver text messages or other similar electronic messages to the phone number you provided for the purpose of providing communications about Vendors or other Event details. Message frequency may vary depending on your registration type. NextHome does not charge for this service, however, message and data rates may apply from your mobile carrier. If you have any questions or need help, please reply HELP in the message thread or contact NextHome at memberservices@nexthome.com. You may opt-out of NextHome’s messaging program at any time by sending STOP, QUIT, or other clear opt-out language in the messaging thread. You agree that after submitting an opt-out request, NextHome is able to send one (1) confirmation message to confirm your opt-out intent and inform you of possible Event related information that will no longer be delivered via text message or other similar electronic messaging services. Upon confirmation or receiving no response, NextHome shall remove you from the messaging service within ten (10) business days. If you wish to restart the receipt of messages, you must opt-in to the message thread again.
EVENT SAFETY
- Personal Conduct and Responsibility. NextHome will take reasonable precautions to provide a safe environment for the Event, but you are ultimately responsible for your own well-being. You are expected to conduct yourself as a responsible adult throughout the duration of the Event. This includes, without limitation, refraining from disruptive behavior, use of offensive language, and engaging in activities that may jeopardize your personal safety or the safety of other Attendees. It is your responsibility to exercise good judgment and avoid placing yourself in compromising situations. NextHome shall not be held liable for any consequences resulting from your failure to act responsibly. If you are drinking alcohol at or in connection with the Event, you are encouraged to drink alcohol responsibly and to be aware of your own limits. NextHome reserves the right to eject you from the Event if you appear intoxicated, without refund, and you may be precluded from participation in future NextHome events. You must avoid situations that may lead to conflicts or disturbances. In the event of a dispute, you are expected to resolve the issue peacefully and promptly, seeking assistance from Event staff, if necessary. By participating in the Event, you affirm your commitment to maintaining a safe and respectful environment for all Attendees. Any violation of this provision may result in your removal from the Event venue, without refund for Event ticket purchases.
- Assumption of Risk. Participation in the Event involves inherent risks, including, but not limited to, illness, bodily injury, disability, death, and property damage or loss (collectively, “Injuries”). Subject to applicable laws, you voluntarily assume all risks associated with attending the Event and hereby irrevocably release NextHome (including its Event personnel and/or representatives) from any liability for such risks.
- Safety Protocols. You agree to adhere to any and all safety protocols when attending the Event, as may be implemented by, (a) federal, state, or county officials; (b) NextHome; (c) the facilities or venues at which the Event is being held; and/or (d) third-parties providing services, recreation, or entertainment at the Event. You understand that your agreement to comply with all applicable safety protocols is a condition of your invitation to participate in the Event. Failure to comply with any safety protocols may result in your removal from the Event venue, without refund for Event ticket purchases.
- Health and Well-being. The health and well-being of all Attendees are NextHome’s top priorities. To ensure a safe and enjoyable Event for everyone, if you are feeling unwell, experiencing symptoms such as fever, cough, or sore throat, or have tested positive for a contagious illness, you should refrain from attending the Event to protect the health of others. In an effort to mitigate risks associated with contagious illnesses, NextHome will fully comply with all applicable health-related rules and regulations, including those promulgated by federal, state, county, district, and city authorities, as well as the authorities managing the Event venue. By attending the Event, you represent and warrant that you are symptom-free and have not been advised to isolate or quarantine.
- Evacuation Routes. You understand the importance of being aware of and familiarizing yourself with evacuation routes in case of an emergency, and agree to do so in advance of any emergency.
EVENT CONDUCT
- Standard of Conduct. NextHome is committed to providing and maintaining a productive, inclusive, respectful, and welcoming environment for all Attendees at NextHome-related events. Attendees are required to behave in a manner that is appropriate and in line with the expected level of dignity and respect suitable for the Event. Accordingly, you agree to comply with the following standards of conduct throughout the Event:
- Mutual Respect: Be courteous and respectful to Event Staff, Vendors, and other Attendees. You must refrain from any behavior or speech that interferes with others’ ability to safely participate in or enjoy the Event (including, without limitation, demeaning, discriminatory, or harassing conduct).
- Situational Awareness: Be mindful of your surroundings and immediately alert Event staff if you notice a dangerous situation, safety hazard, or someone in distress.
- Compliance with Staff: Comply immediately with all requests, directions, and instructions from Event staff regarding operational, security, and emergency procedures.
- Identification: Wear your official Event badge or other provided participant identification at all times while at the Event or within Event venues.
- Venue Care: Respect the Event venue by adhering to all posted rules, policies, and guidelines, and refraining from damaging or altering Event venue property).
- Follow the Law: Abide by all applicable federal, state, and local laws and regulations at all times during the Event.
- Unacceptable Behavior. You understand and agree that unacceptable behavior will not be tolerated from any Attendee, Vendor, Event staff, or other person present at the Event. Anyone asked to stop engaging in unacceptable behavior is expected to immediately comply. Event Staff may take any action they deem appropriate, in their sole discretion, in response to unacceptable behavior (including, without limitation, expulsion from the Event without warning or refund, and/or the involvement of local law enforcement). Unacceptable behavior includes, but is not limited to:
- Harassment and Discrimination: Intimidating, harassing, abusive, discriminatory, derogatory, or demeaning conduct towards any person or group. Because Event venues may be shared with the public, all Event participants must remain respectful to all patrons of these locations.
- Abuse and Intimidation: Physical or verbal abuse, intimidation, threats, annoyance, stalking, pushing, shoving, or use of any physical force whatsoever against any person, which in any way creates a disturbance that is disruptive or dangerous, or creates apprehension in any person, as determined by Event staff, in their sole discretion.
- Weapons: Possession of a weapon, any item that can be used as a weapon, or any object intended to threaten or cause injury to others.
- Property Damage: Any destruction, defacement, or vandalism of personal property, Event venue property, or Event materials.
- Offensive Conduct: Any boisterous, lewd, or offensive behavior or language, including sexually explicit conduct, profanity, obscene gestures, or racial, religious or ethnic slurs.
- Alcohol Misuse: Possessing any open container containing an alcoholic beverage outside of areas specifically designated for alcohol consumption, or being intoxicated, as determined by Event Staff, in their sole discretion.
- Illegal Substances: Possessing, using, or distributing any illegal substance, narcotic, or drug. (Note: the use or possession of cannabis/marijuana is strictly prohibited in Event venues, regardless of local legalization status).
- Smoking and Vaping: Smoking, vaping, or using electronic cigarettes outside of explicitly designated smoking areas.
- General Illegal Activity: Engaging in any other illegal activity or violating any federal, state, or local laws not otherwise specified above.
- What to Do if You Witness or are Subjected to Unacceptable Behavior. You should report any behavior inconsistent with these principles to onsite Event staff. Event staff will be happy to help you contact venue security or local law enforcement, provide escorts, or otherwise assist you for the duration of the Event. We value your attendance. You may also contact NextHome directly to report a concern at memberservices@nexthome.com.
- Ejectment. If NextHome determines, in its sole and absolute discretion, that you have violated, or are in violation of, any of the terms or conditions within these Terms, then you may be immediately ejected from the Event, without refund for Event ticket purchases, and you may be precluded from participation in future NextHome events.
PERSONAL INFORMATION COLLECTION BY VENDORS AT EVENT
By registering for and attending this event, you acknowledge that Vendors may directly request your personal information at their exhibit booths, sessions, programs, or presentations (collectively, “Non-NextHome Gathering(s)”). Providing your personal information to Vendors is optional, and you have the right to refuse to do so; you should review each applicable Vendor’s privacy policies to address your particular needs and concerns about how they will treat your personal information. If, during the Event, you attend a Non-NextHome Gathering, you understand and agree that when you provide personal information to a Vendor, that personal information will go to a non-NextHome entity and NextHome takes no responsibility for, (1) the privacy practices of that entity; (2) how that entity uses your personal information; or (3) where in the world that entity may transfer your personal information.
USE OF PHOTOGRAPHIC AND VIDEO MATERIAL TAKEN AT EVENT
- Attendee’s Content. Unless otherwise prohibited by these Terms, you are permitted to use hand-held cameras or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever. However, you are encouraged to capture your Event experiences and post your own social content from the Event (text, photos, audio, video, streaming), provided that doing so does not infringe upon the rights of any third party or NextHome. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. You shall be and remain solely responsible for securing any releases or permissions that may be required by third parties whose image(s), likeness(es), or voice(s) may have been captured within your social content.
- NextHome’s Content. NextHome may hire professional service providers (photo/video/streaming/audio) to document and display the Event experience. NextHome may also use social media channels to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds on monitors throughout the Event venue. By entering the Event, you are entering an area where photography, audio, and video recording may occur. Your entry in and attendance at the Event venue, (a) constitutes your voluntary consent to be photographed, filmed, or otherwise recorded, and to NextHome’s release, editing, publication, exhibition, or reproduction (collectively, “Use”) of any and all recorded media of your appearance, voice, and name (collectively, “Likeness”) for any purpose whatsoever in perpetuity in connection with NextHome, including, by way of example only, use in websites, social media, news, and advertising; (b) constitutes your irrevocable waiver and release of any claims you may have against NextHome related to the use of recorded media of you at the Event (whether such recording is performed by or on behalf of NextHome for its business purposes, or by any Attendee or Vendor for their own purposes), including, without limitation, any right to inspect or approve the recorded media of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement; and (c) constitutes your agreement that you are not entitled to any royalties or fees from NextHome in connection with its Use of your Likeness for any purpose. You understand all photography, filming or recording will be done in reliance on the foregoing. If you do not agree to the foregoing, please do not enter the Event venue.
- Restrictions on Photography, Recording, or Streaming. Notwithstanding anything contrary to these Terms, NextHome reserves the right, in its sole and absolute discretion, to prohibit photography, video/audio/digital recording, and/or streaming during certain sessions or within certain function spaces. NextHome will communicate any such restrictions through signage, on-screen messages, announcements during such sessions, or by any other means it deems appropriate. You must comply with these restrictions when provided. Failure to do so may result in immediate ejection from the sessions or function spaces at the Event without refund for Event ticket purchases, and denial of your participation in future NextHome events. Further, you are prohibited from hiring, engaging, or otherwise authorizing any person or company to perform or provide any audio, visual, recording, or streaming services at or in connection with the Event (whether for compensation or free of charge) without the prior written consent of NextHome. Any person or company engaged in violation of this policy may be removed from the Event, and NextHome will not be responsible for any costs or expenses you incur as a result of NextHome’s removal of that person or company.
- Equipment Restrictions. No Attendee or Vendor may bring, use, or operate any projector, loudspeaker, megaphone, sound amplification device, or similar equipment capable of projecting sound or images to others at or in connection with the Event, without the prior written consent of NextHome. NextHome may cause the removal of any unauthorized device from the Event venue, and NextHome will not be responsible for any costs or expenses you incur as a result of such removal. Violation of this policy may result in your immediate ejectment from the Event without refund for Event ticket purchases or sponsorship fees, and denial of participation in future NextHome events.
PROMOTIONAL GUIDELINES
Attendees may engage in promotional activities or distribute promotional materials at the Event in accordance with the following guidelines. NextHome reserves the right, in its sole and absolute discretion, to restrict, stop, or confiscate any promotional activities or materials that do not adhere to these guidelines. Failure to comply with these guidelines may result in your removal from the Event venue, without refund for Event ticket purchases.
- Content Restrictions. All promotional activities and materials must exclusively promote your real estate business with NextHome. You may not promote any competing products, services, companies, or events, or any other business ventures (e.g., property management or transaction coordinator services), at the Event, without written permission from NextHome.
- Approval Process. Before engaging in any promotional activities or producing any promotional materials intended for the Event, you must submit final concepts, plans, or design proofs to NextHome’s Marketing team for review and approval. Only promotional activities and materials that have been approved by NextHome, in writing, will be permitted at the Event.
- Distribution. You are solely responsible for the execution and distribution of your approved promotional activities and materials at the Event. NextHome and Event staff will not provide any assistance with such execution and distribution. Further, you may not hire, engage, or otherwise authorize any person or company to assist with such execution or distribution, without written permission from NextHome.
- Attendee Responsibility. You are solely responsible for managing your promotional activities and materials before, during, and after the Event, including the collection of all extra or leftover items from the Event venue. NextHome assumes no responsibility, and shall not be held liable, for any consequences resulting from your failure to adhere to these guidelines, including, without limitation: (i) any of your promotional material that is discarded or destroyed during Event venue resets, daily cleaning, or final breakdowns; or (ii) any costs or expenses you incur in connection with the denial, confiscation, disposal, or termination of unauthorized promotional activities or unapproved promotional materials.
LIABILITY WAIVER & RELEASE
You hereby represent and warrant that, (a) you are older than the age of majority in both your geographic area, and in the geographic area where the Event is being held; (b) you are of sound mind and competent to enter into legally binding agreements; (c) you have read, understood, and voluntarily agree to be bound by these Terms; and (d) your agreement to these Terms is made of your own free will, without any coercion or undue influence. As a material inducement to NextHome for allowing you to participate in the Event, you, on behalf of yourself and your spouse, estate, executors, heirs, devisees, trusts, trustees, beneficiaries, employers, and any businesses that you own or manage (collectively, “Your Parties”), irrevocably and forever release, waive, discharge, exonerate, and hold harmless, NextHome, its parent companies, subsidiaries and affiliates, and all of its or their respective members, managers, officers, directors, shareholders, employees, agents, successors, and assigns (collectively, the “NextHome Parties”), jointly and severally, from any and all demands, claims, causes of action, monetary and non-monetary liabilities (including reasonable attorneys’ fees and costs), whether based on tort, contract, statute, common law, or any other type of legal or equitable theory which could be asserted by Your Parties in any court of competent jurisdiction, whether known or unknown (collectively, “Claims”), arising from or in any way related to any Injuries, or any other harm you suffer, whether occurring before, during, or after the Event, whether occurring at or away from the Event venue, except insofar as such Injuries or other harm were suffered as a result of NextHome’s willful misconduct (as manifested through its employees, and none other) during the Event and while at the Event venue.
ADDITIONAL TERMS AND CONDITIONS.
- Amendments. NextHome reserves the right to update these Terms at any time, in its sole direction, and without prior notice. You agree to be bound by such revisions, whatever they may be. These Terms, as may be updated, will be available for viewing at the following URL: https://www.nexthome.com/event-terms-and-conditions/. You are solely responsible for staying apprised of the latest Terms, to which you will be bound. If any condition(s) in these Terms should become invalid, the remaining conditions will continue to be valid and apply.
- Governing Law. These Terms will be construed in accordance with the laws of the jurisdiction where the Event is being held (“Event Jurisdiction”) (without giving effect to that jurisdiction’s choice of law rules), and to the extent controlling, the federal laws of the United States of America. The forum for any dispute or litigation arising out of these Terms shall be in the jurisdictional courts situated in the Event Jurisdiction. You hereby (i) consent to the personal jurisdiction in the Event Jurisdiction for the purpose of legal proceedings; (ii) waive to the extent not prohibited by applicable law, and agree not to assert, by way of motion, as a defense or otherwise, in any dispute or litigation arising out of these Terms, any claim that it is not subject personally to the jurisdiction of courts situated in the Event Jurisdiction, that any such dispute or litigation should be dismissed on grounds of forum non conveniens, should be transferred or removed to any court other than the one of the above-named courts, or that these Terms or the subject matter hereof may not be enforced in or by such court; (iii) agree not to commence any litigation other than before one of the above-provided courts; and (iv) agree that for any litigation or legal action between you and NextHome arising out of these Terms, you shall bring such action only in the Event Jurisdiction and waive any claim and will not assert that venue should properly lie in any other location within the selected jurisdiction. Notwithstanding the previous sentence, you may commence any litigation or proceeding in a court other than the above-named courts solely for the purpose of enforcing an order or judgment issued by one of the above-named courts.
- Vendor Opinions. The ideas, views, policies, and opinions (collectively, “Views”) expressed by any Vendor (including those expressed at any Non-NextHome Gatherings) are not necessarily the Views of NextHome. The products and services displayed by Vendors at the Event should not be construed as being recommended or endorsed by NextHome. In issues affecting legal, financial or accounting matters, you should consult trained professionals to address your individual situations.
- Event Cancellation. NextHome may, in its sole and absolute discretion, cancel the Event at any time and for any reason. If such cancellation occurs, NextHome may issue refunds as determined in its sole and absolute discretion.
